In view of the proposed order being passed, notices to respondent Nos.2 to 4 are dispensed with. Heard learned counsel for the revisionist and learned A.G.A. for the State-respondent no.1. The present revision petition has been filed by the revisionist against the order dated 03.08.2024 passed by Chief Judicial Magistrate, Hardoi in Misc. Case No.1389/2023 by which the application under Section 156(3) Cr.P.C. filed by the revisionist has been dismissed. A perusal of the affidavit filed in support of application for condonation of delay i.e. IA/1/2025 shows that delay of 114 days has not been explained at all. It is only a three paragraph affidavit in which no ground has been mentioned, no date has been mentioned, no other effort has been made by the revisionist to explain the delay thus, delay condonation application is dismissed. Even on merits, a perusal of the impugned order shows that learned court below while rejecting the application under Section 156(3) Cr.P.C. has considered the report of the Chief Medical Officer which was on record before it. In view of above, this Court finds that the version of the revisionist was highly improbable, there appears to be no illegality in the order impugned and thus, the revision is dismissed.
