Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitionerwas arraigned as A.1 in Crime No.382 of 2024 of Bobbili Town Police Station, Vizianagaram District, registered for the alleged offence under Sections 316(2) and 318(2) of the Bharatiya Nyaya Sanhita, 2023, on the strength of the complaint of the 2nd respondent. 3. It is alleged in the complaint that the petitioner company is under consignment of shipment of X-ray Fluorescence Spectrometer to the 2nd respondent company. However, with a dishonest intention, the petitioner's company violated the terms and conditions mentioned in the agreement with the 2nd respondent company. 4. The learned counsel for the petitioner submits that the petitioner was implicated in the case without evidence. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. -3- CRL.P. No.3626 of 2025 5. Considering the submissions of the learned counsel for the petitioners, the Station House Officer, Bobbili Town Police Station, Vizianagaram District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.382 of 2024. This order would not preclude the investigation officer to file charge sheet or final report after completion of the investigation. 6. Accordingly, the criminal petition is disposed off. 7.
