law against the order passed by the Appellate Authority, if so advised.
WP(C) No.2240/2025:
4. The petitioners in this petition have impugned the
order dated 12.06.2025 passed by the Central Administrative Tribunal, Srinagar (for short “the Tribunal”) in O.A No.621/2025 titled “Mujeeb Naseer Bhat and another vs. J&K Services Selection Board and others”, whereby the respondents have been allowed to submit their application forms for the posts of Junior Engineer (Civil) and Naib Tehsildar, under OBC category, with an undertaking that the same shall be subject to submission of OBC certificate issued by the competent authority.
5. The OA depicts that the respondents had pleaded about rejection of their application for issuance of OBC certificates and also about pendency of the appeal before the Appellate Authority.
6. The learned Tribunal has passed the order impugned in this writ petition on the premise that the competent authority has not issued the certificates despite taking sufficient time whereas the fact remains that the application of the respondents for issuance of OBC certificate was rejected, regarding which the respondents had filed an appeal before the Appellate Authority. Further the appeal

preferred by the respondents stand already dismissed. Therefore, the order passed by the learned Tribunal is not sustainable in the eyes of law. Accordingly, the writ petition is allowed and the order passed by the learned Tribunal is set aside.
