IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.3864 of 2025 ------ Jayram Yadav @ Jairam Kumar @ Jairam Yadav, son of Hulash Yadav, resident of village Aamin, PO and PS Hunterganj, District Chatra … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Naresh Pd. Thakur, Advocate. For the State : Ms. Bandana Sinha, A.P.P. ----- 04/ 09.05.2025 Heard the parties.
2. The petitioner is praying for grant of bail as he is in custody for allegedly committing offence punishable under Sections 147, 148, 149, 323, 324, 325, 307, 341, 342, 427, 448, 354, 379, 504, 506 and 120- B of the Indian Penal Code in connection with Hunterganj P.S. Case No.142 of 2023 corresponding to S.T. No.42 of 2024, pending in the Court of learned Additional Sessions Judge-I, Chatra.
3. Prayer for bail of this petitioner was earlier rejected twice. On merits it was rejected on 19.01.2024 holding that the petitioner has given a rod blow on the head of Shiv Kumar Yadav as a result of which he died.
4. Now during course of argument it has been brought to the notice of this Court that out of 15 witnesses 12 have already been examined. Now only 3 witnesses remained to be examined. Thus examination of the witnesses is at the fag end.
5. Considering the nature of the allegation and the stage of trial, I am not inclined to grant privilege of bail to this petitioner.
6. The trial Court will take steps so that the prosecution witnesses can be examined within a period of three months.
7. Accordingly, this bail application is dismissed.
