Apart from the fact that as per the opposite parties, a final assessment order was passed on 16.08.2021, by which all claims have been sent to the petitioner by Registered Post, receipt of which is being denied by the petitioner, it is also informed that after passing of the impugned recovery certificate, the petitioner had applied for one time settlement under the OTS Scheme, which was also accepted and in pursuance to which, the petitioner deposited an amount of Rs.3,46,826/- but thereafter did not deposit the installments as agreed upon. None of these facts have been disclosed herein. The earlier Writ Petition of the petitioner was dismissed on the ground of concealment of material fact. Now again these material facts have been concealed. Though there is a cursory reference to deposit of the aforesaid amount of Rs.3,46,826/- on 17.12.2024 but without reference to any OTS application submitted by the petitioner under the OTS Scheme, therefore, for all these reasons, we do not find it a fit case for interference in the matter. A copy of the final assessment be provided by the counsel for the Electricity Corporation within 24 hours to the petitioner, who may, if it is still permissible in law, challenge the same. The Writ Petition stands disposed of. It is also open for the opposite parties to communicate the entire facts including the application, if any, submitted by the petitioner under the OTS Scheme and steps taken thereafter which, according to them, have not been disclosed in this Writ Petition, within ten days from today.
