Mr. Alok Kumar, Advocate for the petitioner. Mr. Saurav Adhikari, Advocate for Union of India. 2. According to petitioner, a wall in the house in which she is residing, has collapsed. The Cantonment Board has granted permission to petitioner to repair said wall; however, respondent No. 3 is not permitting petitioner to undertake repair work. Permission granted by Cantonment Board is enclosed as Annexure-1 to the writ petition. 3. Perusal thereof reveals that Cantonment Board has asked the petitioner, as well as respondent No. 3 to remove, repair or protect the wall within 30 days. 4. Learned counsel appearing for respondent No. 1 submits that a civil suit is pending regarding house in question before the Civil Judge, Kotdwar, District Pauri Garhwal. 5. This Court do not find any reason to pass any order in favour of the petitioner. Order, if any, passed may tilt the scale in her favour in the pending suit. 6. Since the dispute regarding the house in question is pending before Civil Court, therefore, it would be appropriate for petitioner to move application in the pending suit for appropriate remedy. 7. For a period of two months, no coercive action shall be taken against the petitioner by the Cantonment Board for not repairing the wall. 8. Accordingly, the writ petition stands disposed of.
