1. The instant application is filed by the appellant for seeking extension of bail granted by this Court vide order dated 01- 01-2025, passed in CrlA (D) No. 74/2024. The extension of bail is sought primarily on the ground that the appellant continues to suffer from different ailments and, therefore, it would not be safe to lodge him in the jail.
2. Having heard learned counsel for the parties and perused the material on record, we find that vide order dated 01-01- 2025, this Court while disposing of CrlA (D) No. 74/2024 and having regard to the medical conditions of the appellant, granted bail to the appellant on medical grounds for a period of three months. On the expiry of three months, the appellant reportedly surrendered on 01-04-2025 and is presently in the judicial custody.
3. With a view to verify the veracity of the contents of the application, we had asked the respondent to file a fresh status report with regard to the health of the appellant.
4. The Medical Superintendent of Special Jail Pulwama has filed an affidavit supported by a medical record of SMHS Hospital which was passed on by the learned counsel for the respondent in the open Court and was taken on record. From perusal of the affidavit of the Jail Superintendent and the medical record appended thereto, it seems that the appellant has been discharged from the Hospital and has been put on follow up treatment.
5. In view of the improvement in the health condition of the appellant, the extension in the bail granted by the order dated 01-01-2025 is not called for at this stage.
6. This application is, therefore, dismissed, leaving it open to the appellant to approach the trial Court in case the medical condition of the appellant deteriorates and warrants his release on bail on medical grounds.
