It is submitted that the applicant had $led the present appeal before this Court on 26.12.2024 within the limitation period, however, the Registry of this Court raised objection with regard to non-$ling of certi$ed copy of impugned judgment dated 5.11.2024. It is averred in the application that the impugned judgment dated 5.11.2024 was applied by the counsel of the applicant on 04.12.2024 and the same was delivered on 31.12.2024. It is further averred that this Court was closed on account of winter vacations, and thereafter the learned counsel for the applicant $led a certi$ed copy of the impugned judgment dated 5.11.2024 in the Registry of this Court due to which a delay of 27 days has occurred in $ling the present appeal. It has been further contended by the learned counsel for the applicant that the delay in $ling the appeal is neither intentional nor willful and the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant. Keeping in view the averments as made in the application, which is duly supported by an a0davit and in view of the fact that the learned counsel for the respondent has no objection in case delay is condoned, the present application is allowed and the aforesaid delay in $ling the present appeal is condoned. Mr. Rishabh Negi, Advocate, has put in appearance on behalf of the respondents except respondents No 11 and 23. It is submitted by learned counsel for respondents that respondent No.11 who is yet to be served is the real brother of respondent No. 10 Sohan Singh for whom learned counsel has appeared. It is also informed by the learned counsel that he shall supply the correct address of respondent No.11 to the learned counsel for the applicant within a period of one week from today. Admit. Subject to deposit of entire awarded amount alongwith up-to-date interest by the applicant in the Registry of this Court within a period of eight weeks from today, operation of impugned judgment dated 05.11.2024 passed by the learned Court below and also the arbitral award daated 18.4.2023 shall remain stayed during the pendency of the appeal.
