( 2025:JHHC:16187 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.4844 of 2025 ------ 1. Ajit Mandal @ Bablu Mandal, aged about 42 years, son of Nagen Mandal, R/o Village Ghanti Shimla, P.S. + P.O.-Narayanpur, District Jamtara. 2. Ananda Mandal, aged about 19 years, son of Ajit Mandal, R/o Village Ghanti Shimla, P.S. + P.O.-Narayanpur, District Jamtara. .... .... …. Petitioners Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioners : Mrs. Suman Saurav, Advocate : Mr. Vishal Srivastava, Advocate For the State : Mr. Gautam Rakesh, Addl.P.P ------ Order No.02 Dated- 19-06-2025 Heard the parties. The petitioners have been made accused in connection with Narayanpur P.S. Case No.37 of 2023 registered for the offences punishable under Sections 147, 149, 323, 325, 307 and 302 of the Indian Penal Code. Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners were member of an unlawful assembly and being armed with deadly weapons committed murder of Vishnu Mandal and attempted to murder Rakesh Mandal and Basu Mandal. It is submitted that the allegation against the petitioners is false. It is next submitted that genesis of the occurrence is that the son of the informant enticed away the minor daughter of the petitioner no.1 who is the sister of the petitioner no.2 and from the side of the petitioners Narayanpur P.S. Case No.35 of 2023 was first instituted and as a counterblast, this false case has been foisted. It is next submitted that there is no allegation of using any weapon by the petitioner in committing the alleged assault. It is also submitted that the petitioners undertake that they will co-operate with the trial of the case. It is lastly submitted that the petitioners have been in custody since 07.01.2025 as is evident from para- 01 of the instant bail application. Hence it is submitted that the petitioners be released on bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that the petitioners are named in the FIR, the petitioners were absconding for over two years and there is direct allegation against the petitioners of committing murder of Vishnu Mandal, hence, there is every chance of the petitioners again absconding and tampering with evidence, if released on bail. It is therefore submitted that the petitioners ought not be released on bail. Considering the serious nature of allegation against the petitioners as well as the chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is not inclined to admit the petitioners on bail. Accordingly, the prayer for bail of the above-named petitioners is rejected. (Anil Kumar Choudhary, J.) Abhiraj/
