Neutral Citation No. - 2025:AHC-LKO:14364-DB Court No. - 2 Case :- WRIT - C No. - 1983 of 2025 Petitioner :- Mohmmad Shakeel Respondent :- State Of U.P. Deptt. Nagar Vikas Thru. Prin. Secy. Lko. And 5 Others Counsel for Petitioner :- Ashutosh Mishra Counsel for Respondent :- C.S.C.,Upendra Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. This is backlog fresh. None appears for the petitioner. Sri Upendra Singh, learned counsel for the opposite party Nos.5 and 6 as well as Sri Viond Kumar Singh, learned counsel for the State are present. Fisheries rights were settled in favour of the petitioner as he was the highest bidder, however, the said lease has been cancelled by the impugned order dated 10.02.2025. Prima facie it appears that the petitioner was not heard prior to passing of the impugned order. Nevertheless in view of the reasons given for cancellation, it would be better if a post decisional hearing is given to the petitioner and a considered decision be taken afresh. Let this be done within six weeks. The impugned order shall abide by the fresh decision to be taken as aforesaid. The others who may be affected by the grant of lease in respect of the pond may also be heard. The Writ Petition stands disposed of. (Om Prakash Shukla,J.)
