Mr. Alok Kumar, learned counsel for the applicant. 2. Present C528 application has been filed to challenge the order dated 06.08.2022 and order dated 15.01.2025 passed by learned ACJM, Roorkee, Haridwar in Complaint Case No.441 of 2015 ‘Mohan Singh v. Ajay Lal’ u/s 138 of the Negotiable Instruments Act, whereby, by the first order, the non-bailable warrants was issued earlier and subsequently proceedings u/s 82 Cr.P.C. were launched. 3. It is the contention of applicant that the applicant in the aforesaid complaint case has already been bailed out but due to death of his advocate, he could not participate in the proceedings of the aforesaid criminal case. Consequently, initially, the NBW was issued against him and subsequently, the proceedings u/s 82 Cr.P.C. were launched. 4. An innocuous prayer has been made by learned counsel for the applicant that the date fixed in the matter is tomorrow i.e. 18.10.2025. The applicant is inclined to put in appearance in the proceedings for which he seeks 10 days’ time to appear before the learned trial Court. 5. The prayer so made by applicant is innocuous. 6. Keeping in view of the fact in mind that that the advocate of the trial Court has expired due to which he could not participate in the proceedings, hence C528 application is disposed of. The applicant shall appear before the learned Trial Court within ten days from today latest by 27.10.2025. 7. Till then, the NBW dated 06.08.2022 as well as order dated 15.01.2025 u/s 82 Cr.P.C. shall be kept in abeyance. (Pankaj Purohit, J.) 17.10.2025 R.Dang
