Order No.02 Dated-12-06-2025
Heard the parties.
The petitioners have been made accused in connection with Meral P.S. Case No.35 of 2025 registered for the offences punishable under Section 103(1), 85, 3(5) of the B.N.S., 2023 and Section 3, 4 of Dowry Prohibition Act.
Learned senior counsel for the petitioners submits that the allegation against the petitioners is that the petitioners, being the father-in-law and mother-in-law of the deceased, have committed murder of the deceased. It is next submitted that the allegation against the petitioners is false. It is then submitted that the petitioners have been in custody since 16.02.2025 as is evident from para-15 of the instant bail application. Hence, it is submitted that the petitioners be released on bail. Learned Addl.P.P. appearing for the State on the other hand opposes the prayer for bail of the petitioners and submits that the post-mortem report goes to show multiple abrasion on the dead-body of the deceased and also submits that there is direct and specific allegations against the petitioners of having committed murder of deceased, hence, there is every chance of the petitioners absconding, if released on bail. It is lastly submitted that the petitioners ought not to be released on bail.
Considering the serious nature of allegation against the petitioners and the chance of their absconding, if released on bail, this Court is not inclined to admit the above named petitioners to bail at this stage. Accordingly, the prayer for bail of the above named petitioners is rejected.
