Heard learned Counsel for the petitioner as well as learned Standing Counsel. 2. The present petition has been filed with the following prayer: "1. To issue a writ, order or direction in the nature of mandamus commanding and directing to the opp. party no.2 & 3 to remove the illegal encroachment made by opp. party no.4 & 5 over the public path i.e. Land Gata no.598/0.0240 hec. and Land gata no.600/0.0890 hec. situated at Village- Bahamanpur, Pargana- Meeranpur, Tehsil-Sadar, District- Sultanpur, in the interest of justice." 3. Learned Standing Counsel based upon the instructions states that the proceedings have already been initiated against the opposite party no.5, which is pending consideration. 4. In view of the said statement, the present petition is disposed off with a direction to conclude the said proceedings in accordance with law with all expedition preferably within a period of 90 days from the date of production of a certified copy of this order. 5. Insofar as the opposite party no.4 is concerned, in case, he is found to be encroaching, suitable proceedings shall also be initiated against him.
