The learned Assistant Public Prosecutor for the state submits that the Sessions Court initially convicted the accused for the offence under Sections 307, 326 of IPC. The learned counsel for the petitioner submits that the Appellate Court had set aside the order of Sessions Court and remanded the matter to consider afresh and also further submits that as on date the petitioners are not convicted and the matter is pending before the Sessions Court. It is further submitted that the accused No.2 is a soldier in the Army and the accused No.3 is a student. 3. The de facto complainant filed I.A.Nos.2 and 3 of 2025, duly enclosing a Joint Memo entered between the petitioners as well as de facto complainant. It is stated that at the intervention of elders on both sides, the petitioners and the de facto complainant have arrived at an understanding and the matter has been settled between them. 3
4. The learned counsel for the petitioners and learned counsel representing for the unofficial respondent No.1 (de facto-complainant) and learned Assistant Public Prosecutor representing the State are present. 5. Today, when the matter is taken up, petitioners herein/Accused Nos.1to 3 and 1st respondent herein are present before this Court.
