Neutral Citation No. - 2025:AHC-LKO:12092 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 1087 of 2025 Petitioner :- Ram Teerath Respondent :- The Court Of Sub Divisional Officer, Tehsil Tarabganj, Gonda And Others Counsel for Petitioner :- Verender Kumar Tiwari Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel. Sri Pankaj Gupta learned counsel has accepted notice on behalf of respondent no.6. Learned counsel for the petitioner has pointed out that this is the second petition, in as much as, the first petition was permitted to be withdrawn with liberty to file fresh with complete parties. It has further been urged that in the instant second petition, the same defect of non impleadment of the parties is present. Having considered the aforesaid and from a perusal of material on record including Annexure no.2 which is petition under Section 134 of U.P. Revenue Code, 2006, it would indicate that Ram Lautan, Ramautar, Ramketar, Ashok Kumar and Smt. Sona who were the petitioners before respondent no.1 have not been impleaded in the instant petition despite this being a second petition. In view thereof, this Court is not inclined to entertain the petition, accordingly, the petition is dismissed leaving it open for the petitioner to take recourse of Rule 494 of Chapter 50 of the U.P. Revenue Court Manual.
