Neutral Citation No. - 2025:AHC-LKO:12228 Court No. - 6 Case :- WRIT - A No. - 2414 of 2025 Petitioner :- Pankaj Premchandra Yadav Respondent :- State Of U.P. Thru.Addl. Chief Secy. Home Deptt. Lko. And 2 Others Counsel for Petitioner :- Subhash Chandra Yadav Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J.
1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
2. It has been submitted by learned counsel for the petitioner that the petitioner appeared in the recruitment process for the post of Constable in Civil Police, for which the advertisement was issued in the year 2023. The petitioner appeared in the written examination and was declared successful and was again issued another admit card for appearance in the documents verification and physical standards test. The physical test was conducted on 27.01.2025 and the chest of the petitioner was wrong measured as 91 cm without expansion and 95.5 cm with expansion and the difference is less than one centimeter, inasmuch as, had the chest been less than 1 cm in his category, he would have qualified to the next level of the examination.
3. Considering the fact that the difference in chest is less than around one centimeter in the petitioner's category and the same is measured physically, there are chances of human error and as interference has already been shown in other matters and the Medical Board is also in operation, let the chest of the petitioner be re-determined.
4. Learned Standing counsel on the basis of instructions submits that physical examination test would be conducted till tomorrow i.e., 01.03.2025 till 2:00 p.m. before the specially constituted medical board pertaining to measurement of height/chest.
5. Learned counsel for petitioner submits that petitioner is ready and willing to appear before the Medical Board on 01.03.2025.
6. Learned Standing counsel, on the basis of instructions received from Secretary of the Police Recruitment and Promotion Board, has submitted that the physical test would be
conducted only till 01.03.2025 at 2:00 p.m.
7. Accordingly, the writ petition is allowed. The petitioner is
directed to appear before the Medical Board by 01.03.2025 itself and in case he appears before the Medical Board on 01.03.2025, the respondents would remeasure the chest and further proceed in accordance with law.
8. Learned Standing counsel is directed to intimate the respondents/Medical Board with regard to order passed today forthwith for re-determination of chest of the petitioner by
01.03.2025. This order is being passed on the assurance being given by learned counsel for the petitioner that the petitioner will abide with the fresh determination of chest and will not question the said decision any further. . (Alok Mathur, J.)
