Neutral Citation No. - 2025:AHC-LKO:12186 Court No. - 6 Case :- WRIT - A No. - 2417 of 2025 Petitioner :- Alok Kumar Respondent :- State Of U.P. Thru. Addl. Chief Secy./Prin. Secy. Home Deptt. Lko. And 2 Others Counsel for Petitioner :- Subhash Chandra Yadav,Ashok Kumar Bhaskar,Ashwani Kumar Counsel for Respondent :- C.S.C. Hon'ble Alok Mathur,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. It has been submitted by learned counsel for the petitioner that the petitioner appeared in the recruitment process for the post of Constable in Civil Police, for which the advertisement was issued in the year 2023. The petitioner appeared in the written examination and was declared successful and was again issued another admit card for appearance in the documents verification and physical standards test. The physical test was conducted on 22.01.2025 and the height of the petitioner was wrongly measured twice and found to be 167.7 and 167.7 cms and the difference is less than one centimeter, inasmuch as, had the height been 168 cms, they would have qualified to the next level of the examination. 3. Considering the fact that the difference in height is less than one centimeter and the same is measured physically, there are chances of human error and as interference has already been shown in other matters and the Medical Board is also in operation, let the height of the petitioner be re-determined. 4. Learned Standing counsel on the basis of instructions submits that physical examination test would be conducted till tomorrow i.e., 01.03.2025 till 2:00 p.m. before the specially constituted medical board pertaining to measurement of height. 5. Learned counsel for petitioner submits that petitioner is ready and willing to appear before the Medical Board on 01.03.2025. 6. Learned Standing counsel, on the basis of instructions received from Secretary of the Police Recruitment and Promotion Board, has submitted that the physical test would be conducted only till 01.03.2025 at 2:00 p.m. 7. Accordingly, the writ petition is allowed. The petitioner is directed to appear before the Medical Board by 01.03.2025 itself and in case he appears before the Medical Board on 01.03.2025, the respondents would remeasure the height and further proceed in accordance with law. 8. Learned Standing counsel is directed to intimate the respondents/Medical Board with regard to order passed today forthwith for re-determination of height of the petitioner by 01.03.2025. This order is being passed on the assurance being given by learned counsel for the petitioner that he will abide with the fresh determination of height and will not question the said decision any further. .
