Neutral Citation No. - 2025:AHC-LKO:13379-DB Court No. - 1 Case :- SPECIAL APPEAL No. - 86 of 2025 Appellant :- Neetu Singh Kushwaha Respondent :- State Of U.P. Thru Addl. Chief Secy. / Prin.Secy. Revenue Deptt. Lko And Ors. Counsel for Appellant :- Sajjad Husain,Sanjay Shukla Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J. 1. Supplementary affidavit filed on behalf of the appellant in court today is taken on record. 2. Heard learned counsel for the appellant, learned Additional Chief Standing Counsel appearing on behalf of the State and perused the records. 3. This intra court appeal under Chapter VIII, Rule 5 of Allahabad High Court Rules is directed against the judgment/order dated 28.01.2025, passed by the writ court in Writ-A No.10132 of 2024, whereby while dismissing the writ petition against the cancellation of the attachment order, the appellant/petitioner has been permitted to join her duties in her parent cadre i.e. District Unnao. 4. Having a glance to the U.P. Consolidation Departmental Ministerial and Draft Staff Service rules, 1980, it is amply clear that the appellant belongs to the subordinate cadre of District Unnao. The appointment order issued in her favour was also issued under the signature of Settlement Officer Consolidation, Unnao. Therefore, there is no room for doubt that the appellant/petitioner belongs to the headquarter cadre. 5. On a close scrutiny of the order impugned herein, we do not gather any illegality in the order passed by the writ court calling for any interference. The writ court having appreciated all these aspects in the light of statutory rules has passed the judgment impugned herein, which does not suffer from any illegality. 6. The intra court appeal being bereft of any merit is dismissed. 7. In case the appellant has not joined her duties as on date, she is granted last opportunity to resume her duties at District Unnao within a period of two weeks from today.
