The present application under Section 482 Cr.P.C. has been filed for the following main relief(s):- "Wherefore, it is most respectfully prayed that this Hon'ble court may kindly be pleased to quash the impugned order dated 05.10.2023 passed in case no. 2042/2023 arising out of case crime no. 85/2023 under section 363, 366 I.P.C. P.S. Kotwali Dhaurahara District Kheri (State Vs. Arman) passed by judicial magistrate court no. 1 Lakhimpur Kheri as contained in Annexure no. 1 to this petition in the interest of justice. It is further prayed that this Hon'ble court may kindly be pleased to direct the learned court below to initiate the criminal proceeding under section 363, 366, 376(3), 120-B I.P.C. and 3/4 POCSO Act in case crime no.85/2023 P.S. Kotwali Dhaurahara District Kheri (State Vs. Arman) against the opp. party no. 2 to 4 in the interest of justice." The operative of the order dated 05.10.2023 dated is quoted herein below :- "ससुनना व पतनावलली कना अवललोकन ककयना । प्रपतत्रों कके अवललोकन सके उत्लकेखनलीय हहै कक प्रश्नगत मनामलके मम प्रथम ससूचनना ररिपलोरर वनादली मसुकदमना अशफनाक दनारिना पपंजलीकक त करिनायली गयली हहै। प्रनाथर्थी अशफनाक दनारिना जलो तथ्य वकररत ककयके गयके हह तथना सम्पसूरर कके स डनायरिली कके अवललोकन सके इस स्तरि परि प्रश्नगत मनामलके मम अकभियसुक्तगर कके कवरुद्ध 363,366,376(3), 120B IPC व 3/4 पनाक्सलो एक्र मम सपंजनान मम सपंजनान ललयके जनानके कना कलोई आधनारि नहहीं पनायना जनातना हहै। दसूसरिके वनादली मसुकदमना कलो न्यनायनालय मम यह अवसरि उपलब्ध रिहकेगना कक वह अपनली बनात कलो सनाक्ष्य स्तरि परि रिख सकतके हह। अतएव सपंपसूरर कवश्लकेषर कलो दृकष्टिगत रिखतके हहयके प्रश्नगत मनामलके मसु०अ०सपं० -85/2023 थनानना धधौरिहरिना लजलना खलीरिली मम अकभियसुक्तगर अकभियसुक्त उरिफनान उफर हलीर , अरिमनान व इकलनाख उफर एकलनाख कके कवरुद्ध धनारिना 363,366,376(3), 120B IPC व 3/4 पनाक्सलो एक्र मम इस स्तरि परि प्रसपंजनान ललयके जनानके कना आधनारि पयनारप्त नहहीं हहै। प्रनाथर्थी अशफनाक दनारिना प्रस्तसुत प्रनाथरनना पत कनरिस्त ककयके जनानके यलोग्य हहै तथना पतनावलली परि उपलब्ध कचक प्रनाथकमककी आरिलोप पत व दधौरिनान कववकेचनना सपंकललत सनाक्ष्य तथना कके स डनायरिली कके अवललोकन सके अकभियसुक्तगर अरिमनान व उरिफनान उफर हलीरु कके कवरुद्ध भिनारितलीय दण्ड सपंकहतना ककी धनारिना 363,366 कके अन्तगरत दण्डनलीय अपरिनाध मम प्रसपंजनान ललयके जनानके कना पयनारप्त आधनारि हहै। आदकेश आवकेदक अशफनाक दनारिना प्रस्तसुत प्रनाथरननापत कनरिस्त ककयना जनातना हहै। अकभियसुक्तगर अरिमनान व उरिप हलीरु कके कवरुद्ध मसु०अ०सपं० 85/2023 अन्तगरत धनारिना 363,366 IPC थनान धधौरिहरिना लजलना प्रसपंजनान जनातना हहै। वनाद फधौजदनारिली वनाद कके रुप मम दजर रिलजस्ररि हलो। अकभियसुक्तगर कवरुद्ध सम्मन जनारिली पतनावलली वनास्तके कदननापंक 18.10.2023 कलो वनास्तके हनालजरिली पकेश हलो।" On being confronted, learned counsel for the applicant states that he does not want to press the application and it may be dismissed as withdrawn.
