Gaya, District- Gaya, Bihar … Petitioner -Versus- The State of Jharkhand … Opposite Party ----- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner : Mr. Randhir Kumar, Advocate For the State : Mrs. Amrita Kumari, A.P.P. ----- 07/07.08.2025 The petitioner is apprehending his arrest in connection with Koderma P.S. Case No.200 of 2024, registered for the offence under Sections 98, 99 of Bhartiya Nyaya Sanhita, 2023, Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, pending in the Court of the learned Chief Judicial Magistrate, Koderma. 2. Learned counsel for the petitioner submits that the girls, who have been forced for sex work, were major and in light of that, Sections 98 and 99 of Bhartiya Nyaya Sanhita are not attracted and, as such, the petitioner may kindly be enlarged on anticipatory bail. 3. Learned counsel for the State opposed the prayer and submits that the petitioner was involved in such heinous crime. 4. It transpires that the hotel in question namely Spicy Hotel was opened recently and since initial day of its opening itself, the said hotel was indulged in such crime. Two persons, namely Mahadeo Sao and Sanjay Sao, who are brothers, are said to be the joint owners of the hotel in question, however, the said hotel was handed over to the petitioner-Pintu Paswan and Ashwini Kumar for doing the business of sex work. 5. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, hence, the prayer for anticipatory bail is, hereby, rejected. 6. Accordingly, this application is dismissed. (Sanjay Kumar Dwivedi, J.) Ajay/
