The recovery certificate has been issued in pursuance to an order dated 25.06.2024 passed by a Member, UPRERA under Section 38/40(2)/63 of the Real Estate (Regulation and Development) Act, 2016, therefore, the contention of the petitioner's Counsel is that without there being any such order and during pendency of execution proceedings, the recovery certificate has been issued by the Secretary is apparently incorrect as it has been issued in pursuance to the aforesaid order. 3. In view of the above, no adjudication is required in this case. The aforesaid order passed in execution proceedings is taken on record. 4.
