The Court made the following order: The present revision is filed seeking direction to the execution Court not to finalize the proceedings in E.P.No.68 of 2014 on the file of the Principal Junior Civil Judge, Bapatla, pending disposal of I.A.No.340 of 2015, which was filed to set aside the ex parte decree dated 16.07.2013 in O.S.No.186 of 2010. 2. No representation for the petitioner. 3. When the matter is taken up for hearing, it is brought to the notice of this Court by the District Judiciary that the 1st respondent, who is the petitioner in EP No.60 of 2014, filed a memo stating that she has received all the documents from Judgment Debtors 5 & 6 and does not wish to prosecute the execution petition. The Execution Court, placing reliance on the memo filed by the petitioner/decree holder, closed the execution petition as not pressed by order dated 08.07.2016. 4. In that view of the matter, nothing survives to be adjudicated in the instant revision and accordingly the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs.
