Heard learned counsel for the petitioners and Shri Sharad Kumar Shukla, learned counsel for the respondent-Bank. 2. The present petition has been filed by the petitioner stating that despite the petitioner ready and willing for an OTS settlement, he is not being able to do so. 3. Learned counsel for the respondent-Bank, based upon the instructions, states that in case the petitioner approaches with an OTS settlement, the same will be considered in accordance with law. 4. Learned counsel for the petitioner undertakes that he would approach by moving an appropriate application for OTS settlement. Along with the said, he will deposit an amount of Rs.15 lacs, which shall be kept in a no lien account by the respondent-Bank. The Bank shall thereafter, process the application and pass orders thereupon preferably within a period of one month. The decision so communicated can be agitated by the petitioner in accordance with law. 5. The petitioner shall deposit the amount and move an application on or before 7th March, 2025. 6. The petitioner would be at liberty to move an application before the DRT bringing on record the order passed by this Court. The DRT shall pass a suitable order thereupon, on the said application based upon the order passed by this Court in accordance with law. 7. Any auction that takes place shall be subject to outcome of the OTS settlement. 8. The petition is disposed of in terms of the above.
