The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 16.01.2025, registered as Case Crime No. 16 of 2025, under sections- 3, 5A, 8 of U.P. Prevention of Cow Slaughter Act, 1955 & 4/25 Arms Act, Police Station- Bilariganj, District - Azamgarh, and for a direction to the respondents not to arrest the petitioner in pursuance of impugned First Information Report. 3. The Petitioner claims himself to be the owner of the vehicle wherefrom recovery of alleged beef has been made. Learned counsel for the petitioner submits that he was not not caught and it was his driver who was caught with the alleged beef and he has been falsely implicated in the case. Police investigation is still under way. 4. For the reasons given in the order dated 10.07.2024 passed in Criminal Misc. Writ petition No. 7463 of 2024, till the next date of listing or till cognizance is taken by court on police report submitted under Section 173(2) Cr.P.C., whichever is earlier, the respondents are restrained from arresting the petitioners pursuant to the First Information Report, subject to cooperation in ongoing investigation.
