Petitioner is challenging the order dated 25.2.2025, passed by Deputy Inspector General (Pers. and Adm.), Northern Frontier, ITBP on petitioner’s First Appeal, filed under Right to Information Act. By the said order, Deputy Inspector General declined to provide the information sought for by the petitioner on the ground that the desired information is privileged as per Section 24 of Right to Information Act. 4. Mr. Pankaj Chaturvedi, learned Standing Counsel appearing for the Union of India points out that CBI investigation is going on regarding certain allegations and the documents, which petitioner has sought, are part of the investigation. He further submits that petitioner has remedy of Second Appeal, 2025:UHC:9371 therefore, he should have filed Second Appeal, instead of rushing to this Court. 5. This Court finds substance in the said submission. Whether documents desired by petitioner, are privileged or not, can be looked at by the Second Appellate Forum. 6. The writ petition is, accordingly, disposed of with liberty to the petitioner to approach the Second Appellate Authority under Section 19(3) of the Right to Information Act.
