2. Petitioner was admitted in M.B.B.S. Course in Government Doon Medical College, Dehradun, against a seat earmarked for persons with disabilities.

Principal of Government Doon Medical College, Dehradun has issued a letter to petitioner on 07.10.2024, asking him to get his disability examined from National Medical Commission (NMC) designated disabilities centre. The said letter appears to have been issued to petitioner on account of divergent opinions expressed by three different ophthalmologists regarding eyesight of the petitioner.
4. National Medical Commission (NMC) is represented by Mr. Yogesh Pacholia, Advocate. On instructions, he submits that there are only 16 NMC designated disabilities centres in the whole country, which remain open only when the process of admission for counselling is on and thereafter these centres are closed. He reads the written instructions received by him through WhatsApp, which provides that “as far as
2025:UHC:7665 assessment of candidate under State quota seats are concerned, they may get themselves assessed from the State assigned Medical Board.”
5. Mr. Shailendra Nauriyal,
learned counsel appearing for respondent Nos. 3 and 4/University submits that in view of statement made by Mr. Yogesh Pacholia, Advocate appearing on behalf of MNC, he has no objection if petitioner gets himself examined by State Medical Board, for getting opinion regarding the extent of his visual disability.
6. In view of the concession made by learned counsel appearing for MNC and University, writ petition is
disposed of by directing Director General, Medical Health & Family Welfare, Uttarakhand, to constitute a State Medical Board for assessing the disability suffered by petitioner, within ten days from date of presentation of certified copy of this order.
7. State Medical Board so constituted, shall examine the petitioner and issue a certificate regarding extent of visual disability suffered by him, which shall be produced by petitioner before respondent No. 5.
8. For a period of three weeks, no disturbance shall be caused in the studies of the petitioner.
