Judgment On Board 25.09.2025
1. This appeal under Section 173 of the Motor Vehicles Act, 1988 (for short “Act of 1988”) has been preferred by the appellant/claimant seeking enhancement in the amount of compensation, challenging the impugned award dated 30.07.2022 passed by the 1st Additional Motor Accident Claims Tribunal, Korba, District Korba, Chhattisgarh (for short “Claims Tribunal”) in Claim Case No. 79/2016, whereby learned Claims Tribunal has awarded a total sum of 88,056/- ₹ as compensation along with interest to the injured claimant/appellant herein. 2. Mr. A.L. Singroul, learned counsel for the appellant, would submit that learned Claims Tribunal has erred in awarding less amount of compensation in the facts of the case. Mr. Akash Shrivastava, learned counsel for respondent No.3/Insurance Company, would oppose the prayer made by learned counsel for the appellant and support the impugned award. He would also submit that the amount of compensation awarded by the Claims Tribunal is just and proper which does not call for any interference. 5. I have heard learned counsel for the parties, considered their rival submissions made herein-above and gone through the records precisely. 6.
The Claims Tribunal has assessed the income of the claimant to be 5,860/- ₹ however, in the opinion of this Court, as per the Chhattisgarh Minimum Wages Notification issued by the office of Labour Commissioner, Chhattisgarh, the monthly income of the deceased should be ₹6,000/- (as per minimum wages prescribed at
relevant time) and further considering the facts and circumstances of the case and the nature of temporary
