Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has prayed for the transfer of the proceedings which have been initiated by the respondent against her under Guardian and Wards Act, which proceedings are presently pending before the learned Principal Judge, Family Court, Dehra, District Kangra, H.P. Particulars of the case as mentioned in the petition are as under:- “Custody case filed by the respondent under the Guardian and Wards Act pending before the Ld. Principle Judge, Family Court, Dehra, District Kangra, H.P., titled Rahul Sharma Versus Rita Sharma, Case Registration No.4/2024, with CNR No.HPKA190007932024 may kindly be transferred to the Court of Ld. Principal Judge, Family Court, Una, H.P.” 2. Learned Counsel for the petitioner has submitted that the petitioner is unemployed. She is a destitute lady, who is presently living with her parents at Una. She has a six years old 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:27009 minor child who is being looked after by her and who presently is undergoing education in DAV Centenary Public School, Una. She submitted that in these circumstances, it is extremely difficult for her to travel to Dehra and defend the case at Dehra. Accordingly, she submitted that in the peculiar circumstances, this petition be allowed and the matter be ordered to be transferred to the Court of learned Principal Judge, Family Court, Una, H.P. 3. In the light of the fact that there is no opposition to the prayer made by the petitioner and there is no rebuttal to the contentions raised by the petitioner, this petition is allowed, as prayed for. Case Registration No.4/2024, with CNR No.HPKA190007932024, titled Rahul Sharma Versus Rita Sharma, is hereby ordered to be transferred from Dehra to the Court of Ld. Principal Judge, Family Court, Una, H.P. 4. The petition stands disposed of. Interim order, if any, stands vacated. Pending miscellaneous application(s), if any also stand disposed of accordingly.
