Heard learned counsel for petitioners and learned State Counsel for opposite party no.1. In view of order being passed, notices to opposite parties 2 and 3 stand dispensed with. 2. Petition has been filed seeking a direction to authority concerned for deciding objections filed by petitioners and for recognizing them as members of Madarsa Arbiya Islamia Abul Khair, Village Diwali, Post Bilgram, District Hardoi in the list of General Body members of the said Society for the years 2022-23, 2023-34 and 2024-225. 3. It is submitted that although petitioners have deposited the requisite subscription for their inclusion as member of the General Body for the said years and a resolution of Committee of Management is also there for approving petitioners' inclusion, their names have not been included in the list submitted by Society under Section 4-B of the Societies Registration Act, 1860[hereinafter referred to as the Act of 1860]. 4. Since factual aspects would be involved in adjudication of petitioners' grievance, opposite party no.1, i.e. Deputy Registrar, Firms, Societies and Chits, Lucknow Division, Lucknow is directed to consider and decide objections submitted by petitioners expeditiously prior to approving the list submitted by the Society under Section 4-B of the Act of 1860 after affording opportunity of hearing to all concerned. Petitioners shall provide copies of their objections along with a certified copy of this order to authority concerned. 5. With aforesaid directions, the petition is finally disposed of.
