Heard Smt. Sudha Rani, learned Counsel for the Writ Petitioner, Sri V. Sai Kiran, learned Counsel appearing on behalf of Sri Y. Koteswara Rao, learned Standing Counsel for Gram Panchayat, Sri Panku Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Sri T. Sanjeeva Rao, learned Assistant Government Pleader for Revenue
2. In compliance of the Order of this Court dated 21.03.2025, Sri T. Sanjeeva Rao, learned Assistant Government Pleader for Revenue has submitted the Written Instructions furnished by the Tahsildar, Sabbavaram, dated 01.04.2025. Copy of it is supplied to the Counsel for the Writ Petitioner and the same is taken on record. 3. Serial No.14 of the Written Instructions would indicate that the part of the house belonging to the Writ Petitioner is not in the alignment of NH130CD, and the said structure is obstructing the National Highway work. It is also stated that the 4th Respondent - Tahsildar and the National Highway Authorities have cautioned the Writ Petitioner several times to vacate the said land, but in vain. It is also stated in the serial No.15 that the Writ Petitioner does not have title over the subject land and the said land is classified as ‘Vagu Poramboke’. 4.
Having noted the contents of the Written Instructions, this Court deems it appropriate to dispose of this Writ Petition at the admission stage without going into merit, directing the Official Respondents to follow the due process of law for evicting the Writ Petitioner from unauthorized occupation. 3
