“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and may kindly be pleased to set aside/quash the impugned FIR dated 03/01/2024 registered at Police Station - Mahila Thana, Raipur, District Raipur, for the offence registered under Section 498A and 34 of IPC, against the petitioners (part of the impugned Final Report Dated 24/09/2024, filed as Annexure P/1) and also the impugned Final Report Dated 24/09/2024 bearing Challan No. 96/24, filed before Learned JMFC Raipur, arising out of the FIR dated 03/01/2024 (Annexure P/1) and this Hon'ble Court may further kindly be pleased to set aside/quash the impugned order dated 24.09.2024 vide which the Learned JMFC Raipur has taken cognizance against the petitioners (Annexure P/2), in the interest of justice. Any other relief may also be granted to the petitioner, which this Hon'ble Court deems fit and proper.”
2. It transpires from the record that this Court vide order dated 08/04/2025
directed the parties to appear before the Mediation Center of this Court on 07/05/2025.
3. It has been argued by the learned counsel for the petitioners that in pursuance of the order dated 08/04/2025, parties have appeared before the Mediation Center on 07/05/2025 and 03/06/2025, wherein all the disputes and differences of the parties have been amicably settled by them, therefore, in view of the law laid down by the Apex Court in Manoj Sharma Vs. State and others , (2008) 16 SCC 1, B.S. Joshi Vs. State of Haryana & others, (2003) 4 SCC 675 and Gian Singh Vs. State of
3 Punjab & another, (2012) 10 SCC 303, the impugned FIR be quashed.
4. Learned counsel for the respondent No.2 could not dispute the aforesaid
facts.
5. From perusal of the records, it transpires that both the parties, i.e. petitioners and respondent No.2, have mutually agreed to resolve their disputes amicably and their statements have been recorded in the Mediation Center of this Court, which are on record.
6. Keeping in mind the ratio laid down by the Apex Court in Manoj Sharma (supra), B.S. Joshi (supra) and Gian Singh (supra) and also taking into consideration that the dispute between the parties from which the impugned FIR has emanated has been amicably settled before the Mediation Center of this Court, this Court is of the view that no useful purpose would be served in proceeding any further against the petitioners in this matter.
7. In that view of the matter, the impugned FIR bearing Crime No.1/2024 registered at Police Station Mahila Thana, Raipur, District Raipur dated 03.01.2024 for offence under Section 498 A and 34 of the IPC (BNS) and all consequential proceedings are hereby quashed in respect of the petitioners on the ground of compromise arrived at between the parties before the Mediation Center of this Court on 03/06/2025.
8. Accordingly, the petition is allowed to the extent indicated hereinabove. SD/- SD/- (Bibhu Datta Guru) (Ramesh Sinha) Judge Chief Justice Rahul/ Amardeep
