1.PUBLIC PROSECUTOR The Court made the followin Order: This Criminal Petition under Sections 480 and 483 of BNSS, has been filed by the petitioner herein/Al seeking regular bail in Crime No.86 of 2025 of Gal-uWaka Police Station, registered for the offences punishable under Sections 20(b)(ii)(B) read with 8(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief is that on 28.02.2025, on receipt of credible informatI'On, the Sub-Inspector of Police along with his staff and mediators rushed to old Gajuwaka Bus Stop, and caught the accused in possession of 18Kgs of Ganja. The contraband along with other material was seized and the accused was remanded to judicial custody. a<,--r -
3, Learned counsel fo--r the Petitioner COntendS that the Petit'lOner has been in judicial custody from 28.02.2025 and prays this Court tO grant bail to the petitioner herein.
4| On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner and submits that the petitioner herein has no previous criminal antecedents,

Perused the record. 6, Learned counsel for the petitioner Submitted that the COntraband alleged to be seized from the possession of accused is 18Kgs of ganja, wh'lch is not of commercial quantity. lt is submitted that the petitioner had permanent abode and there is no possibility of his fleeing away from the justice. lt 'ls submitted by the learned counsel for the petitioner that most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation and tamper'Ing Of Witnesses. 7, In view of the aforesaid facts and Circumstances Of the Case and since the contraband involved in the present cr'lme is not a commerc-lal quantity, this court is inclined to grant bail tO the Petitioner herein, 8, ln the result, the Criminal Petition iS allowed With the following conditions: i. The pet'ltioner herein shall be released On bail On h'lS executing a personal bond for Rs.25,000/- (Rupees twenty five thousand Only) With
one surety for a like sum each to the satisfaction of the learned I Additional District & sessions Judge-Special Judge for Trial of Offences under NDPS Act, Vl'sakhapatnam. ii. On release, the petI-tjOner Shall appear before the stall-On House officer concerned, once in a fortnI'ght I'.e., On lst and 15th of every month between 10.00 AM and o1.00 PM., for a period of three (3) months. iii. The petitl-oner shall make himself available for l®nvestigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses.
