Court No. - 1 Case :- SPECIAL APPEAL No. - 85 of 2025 Appellant :- Sajjad Husain Advocate Respondent :- Sri Rajeev Bharti, Registrar General, Allahabad High Court, Prayagraj And Anr. Counsel for Appellant :- In Person Counsel for Respondent :- Gaurav Mehrotra Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard learned counsel for the parties.
2. The contempt proceeding arising out of the
order passed by this Court on 25.10.2024 in Writ-C No.9237 of 2024 have been disposed by order dated 20.01.2025 leaving it open for the petitioner to make a representation before the Registrar General of this Court with a further liberty to approach this Court again for redressal of the grievance if the cause survives. It is this order which has come to be challenged in present intra- court appeal filed under Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952.
3. Sri Gaurav Mehrotra, learned counsel for the High Court has submitted that the intra-court appeal as against the order dated 20.01.2025 is not maintainable for the reason that nothing has been decided by the contempt court exceeding the limits of order dated 25.10.2024 or limiting the scope thereof. It is further informed that the appointment of Oath Commissioners for E-filing is under
consideration and the concerned committee is seized of the matter. As soon as the guidelines are laid down, full compliance of the order passed by this Court which is in progress shall be ensured.
4. During the transitional period the affidavits are attested by the Oath Commissioners manually and such petitions are entertained by the Registry of this Court without causing any hardship to the parties.
5. That being the position the impugned order
does not call for any further clarification once the rights have been reserved for the petitioner to approach the court again.
6. The intra-court appeal is accordingly disposed of. (Subhash Vidyarthi,J.) (Attau Rahman Masoodi,J.)
