Neutral Citation No. - 2025:AHC-LKO:11604 Court No. - 15 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 170 of 2025 Applicant :- Shubham Singh @ Sibbu Singh Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. Counsel for Applicant :- P.K. Singh Bisen,Pallavi Mishra Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant bail application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No. 195 of 2024, under sections 310 (2) of BNS P.S.- Manikpur, District- Pratapgarh. The contention of learned counsel for the applicant is that the applicant is innocent and has falsely been implicated in the instant matter due to ulterior motive. He submits that the motorcycle in question was recovered from home parking yard. He added that there is no substantial evidence against the applicant and he, on the basis of false prosecution, has been implicated. Next added that the application has explained the criminal history and he is seeking parity to one of the co-accused, namely, Adarsh Pandey. Learned A.G.A. appearing for the State has opposed the contentions aforesaid and submits that there are 14 cases of criminal history of the applicant and he is involved in committing offence and offence under Gangster Act has also been charged against the applicant, thus, he is not entitled for any relief. From perusal of the record as well as the criminal history explained, it transpires that the applicant is involved in crime since 2016 and that too in consecutive years, the FIRs are lodged i.e in 2016, 2017, 2019 and 2020. Looking into the repeated criminal history of the applicant, this Court does not find any good ground to intervene in this matter and further this case of the present applicant is distinct than the case of co- accused Adarsh Pandey, thus, the anticipatory bail application is hereby rejected.
