Heard learned counsel for the parties and perused the record. 2. The present petition has been filed by the petitioner with the following prayer: "Wherefore, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to allow instant petition under Art. 227 of the constitution of India with costs by directing the learned Additional Civil Judge (Junior Division) Court No.1, Baharaich to first decide the application for temporary Injunction filed under order 39 rule 1 & 2 in R.S. No. 3037/2023, Achhan Vs Jahir Hasan, before proceeding and passing any order in the Misc. Case No. 230/70/2024, Achhan Vs Jahir Hasan, in the interest of justice." 3. Considering the aforesaid prayer, the present petition is disposed of directing the trial Court to decide the objections filed for recalling the order of exparte injunction prior to deciding the application filed under Order 39 Rule 2.
