Petitioners seek refund of tax deposited by them for the purposes of the advertisement with the Nagar Nigam, Lucknow, based on a decision of this Court, wherein, provision under which the said tax was demanded/deposited, has been declared ultra vires. Petitioners' counsel says that their representation be considered in this regard by the opposite party no.3. 4. Without expressing any opinion on the merits of the case, let the opposite party no.3 consider the claim of the petitioners as per law and take a decision in this regard within six weeks from the date of receipt a certified copy of this order. 5.
