In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Thanapara Police Station Case No.232 of 2022 dated 23.11.2022 under Sections 25(a)/29/35 of the Arms Act and charge sheet submitted under Sections 25(a)/29/35 of the Arms Act.
In Re: Tahajul Hossain Mondal. … … Petitioner
Mr. Prabir Majumder
Mr. S. Majumder
… … for the petitioner Ms. Baisali Basu Ms. Mamata Jana
… … for the State
1. Heard the learned Advocates for the parties.
2. We have considered the materials on record. Large volume of illegal arms and ammunitions were recovered from co-accused. Petitioner’s name transpired during investigation. He absconded for three years and avoided custodial interrogation. Custodial interrogation would have revealed further evidence including recovery of illicit arms.
3. Under such circumstances, we are not inclined to grant anticipatory bail to the petitioner.
4. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
