Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.1 in Crime No.122 of 2024, of Pedanandipadu Police Station, Guntur District, registered for the alleged offence under Sections 196(1), 352 of the Bharatiya Nyaya Sanhita, 2023 and Sections 67 of the Information Technology Act, 2000-2008. 3. It is alleged in the complaint that the petitioner posted the abusive content on social media against the political leaders and caused disturbance to the public peace. 4. The learned counsel for the petitioner submits that on account of political rivalry, the 2nd respondent filed a false complaint against the petitioner. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Pedanandipadu Police Station, Guntur District, is directed to follow the procedure as contemplated under 3 Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the purpose of investigation in connection with Crime No.122 of 2024. 6.
