Neutral Citation No. - 2025:AHC-LKO:11507-DB Court No. - 2 Case :- WRIT - C No. - 1857 of 2025 Petitioner :- Kailash Nath Nigam Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Home Lko. And 4 Others Counsel for Petitioner :- Shyam Bahadur,Krishna Magan Verma Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The petitioner has filed this writ petition seeking a direction to the opp. party No. 2/District Magistrate, Barabanki, for reopening the Main Gate of the petitioner's house at the same place, where it was earlier situated in the old house of the petitioner. The Standing Counsel has instructions to the effect that the petitioner himself has moved application against the private parties alleging illegal construction of a wall by them, but here the case set up is that the Police Inspector, i.e., opp. party No. 5 has also done so and has also beaten up the petitioner. This is not a fit case for interference considering the factual disputes involved, however, if any atrocity has been committed by the opp. party No. 5 with the petitioner, as claimed, he can claim other remedies as may be prescribed in law. As regards the private parties, the petitioner may avail appropriate remedies prescribed in law. With the above observations, this writ petition is disposed of. (Om Prakash Shukla, J.)
