Learned Senior Advocate appearing for the applicant submits that earlier, C528 No.1801 of 2025, Asha Yadav @ Asha Premnath vs. State of Uttarakhand & Others, was filed by the applicant before this Court. 4. A statement has been made by the learned Senior Advocate appearing for the applicant that he intended to withdraw the first C528 No.1801 of 2025 on 13.10.2025 and made a mention before the Co-ordinate Bench of this Court. However, the order could not be transcribed because, at the time when the case was called, the Advocate on behalf of the applicant could not appear due to preoccupation in other Courts. 5. The present C528 No.1880 of 2025 was filed by the same parties on 15.10.2025 before this Court. Since it has now become a second application, which is not maintainable, the learned Senior Advocate seeks to withdraw the present C528 application and to press the earlier one, which is still pending before 2 this Court. 6. In view of the statement made by the learned Senior Advocate appearing for the applicant, the present C528 No.1880 of 2025 is dismissed as withdrawn, with liberty to press the earlier application.
