Neutral Citation No. - 2025:AHC:110656-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 203 of 2025 Petitioner :- Jaideep Kumar Respondent :- State of U.P. and 23 others Counsel for Petitioner :- Abhishek Srivastava, Indra Pal Singh Rajpoot, Rajesh Mishra Counsel for Respondent :- C.S.C., Seema Agarwal (S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition, purportedly in public interest, has been filed by the petitioner, who is State Vice-President of U.P. Pharmacist Welfare Association, inter alia, seeking direction for compliance of Rule 49 of the Drugs and Cosmetics Rules, 1945 ('the Rules'). 2. Submissions have been made that the requirement of qualifications for Drug Inspectors prescribed therein is not being complied with resulting in the likelihood of the general public suffering on account of unqualified Drug Inspectors. Example has been given of one Dinesh Kumar Tiwari, regarding whom allegations have been made that the experience submitted by him, while seeking employment for eligibility purposes, is not in terms of the requirement. 3. Instructions have been obtained by learned Standing Counsel wherein submissions have been made that the allegations made are factually incorrect inasmuch as the appointment accorded to Mr. Tiwari is not based on his experience with the alleged firm, the same pertains to some other firm and therefore, the plea raised in this regard is baseless. Further indications have been made that the qualifications, as required under Rule 49 of the Rules, have been
incorporated in the service rules and all the recruitments are based on the requirement of the Rules and therefore, the plea raised in this regard has no substance. 4. Having gone through the petition, it is apparent that the petitioner has chosen to file this PIL to target the said Dinesh Kumar Tiwari, seeking to question his eligibility to be appointed as Drug Inspector. Nothing has been indicated in the petition as to from where the petitioner obtained the particulars submitted by said Mr. Tiwari during course of his employment and as to whether the petitioner has examined the credentials of all other Drug Inspectors. 5. In view of the above fact situation, wherein the petition, apparently, has been filed for some personal vengeance against the said Dinesh Kumar Tiwari, we do not find any reason to entertain the present petition. The same is, therefore, dismissed.
