Thru. Prin. Secy. Food And Civil Suplies Lko And 2 Others Counsel for Petitioner :- Nitin Srivastava,Pankaj Kumar Dixit Counsel for Respondent :- C.S.C.,Kuldeep Singh Hon'ble Pankaj Bhatia,J. 1. Short counter affidavit filed on behalf of the opposite party no.3 is taken on record. 2. Heard learned Counsel for the petitioner as well as learned Standing Counsel and Sri Kuldeep Singh, learned Counsel for the opposite party no.3. 3. The present petition has been filed challenging the order dated 27.01.2025, whereby the appeal preferred by the respondent was allowed. 4. The contention of the Counsel for the petitioner is that the manner of selecting the candidate for allotment of the fair price shop was flawed and this aspect was taken care of in the order dated 16.04.2024. The said order was challenged by the respondent, which was selected in the open meeting by filing an appeal and the appeal was allowed by means of the impugned order. 5. The contention of the Counsel for the respondent is that the self help group, which is the petitioner herein, was constituted after the year 2020 and was not endorsed by the District Magistrate, which is a condition precedent for the petitioner to have applied for allotment. 6. There is no material on record to show that the petitioner group was granted any endorsement or approval as was required in terms of the Government Order dated 22.02.2023. In the absence of eligibility in favour of the petitioner, the petitioner has no locus to challenge the appointment, as such, no relief can be granted at the instance of the petitioner. 7. The writ petition is dismissed in the above terms. Order Date :- 5.3.2025 akverma Digitally signed by :- ASHOK KUMAR VERMA High Court of Judicature at Allahabad, Lucknow Bench
