Neutral Citation No. - 2025:AHC-LKO:14463-DB Court No. - 2 Case :- WRIT - C No. - 2067 of 2025 Petitioner :- Smt. Savitri Devi Thru. Lawful Attorney Sri Durga Prasad Respondent :- State Of U.P. Thru. Prin. Secy. (Revenue) Lko. And 2 Others Counsel for Petitioner :- Dharmendra Gupta Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. The earlier Writ Petition for the same reliefs has been withdrawn. If the order passed in the earlier Writ Petition is erroneous or some clarification is required then it can always be sought as per law, but, without doing so, the second Writ Petition would not be maintainable. Prima facie, the reliefs prayed herein, which were prayed in the earlier Writ Petition also, the Court was not satisfied with the reliefs, whereupon, the petitioner in view of the relief no.3 prayed in the earlier writ petition, withdrew the petition filed under Article 226 of the Constitution of India and now the petitioner wants to re-agitate relief nos.1 and 2 of the earlier writ petition by means of this second Writ Petition which is impermissible unless the earlier order is recalled or clarified, as the second Writ Petition on the same facts and for the same reliefs is not maintainable in view of the Chapter XXII Rule 7 of The Allahabad High Court Rules, 1952. The Writ Petition stands disposed of. (Om Prakash Shukla,J.)
