MANGENA SREE RAMA RAO Counsel for the Respondent/complainant: 1.PUBLIC PROSECUTOR The Coult made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A4 and A5, seeking regular bail, in Crime No.202 of 2024 of Bhimavaram ll Town Police Station, West Godavari District, registered for the offence punishable under Section 108 of the BNS. 2. The prosecution's case is that on 25.08.2024, the complainant filed a report before the police stating that his father by name Damma Venkateswara Rao (hereinafter referred to as 'the deceased'), was running a chit fund business. Some members of the chit fund, along with others, took their chit amounts but failed to pay the installments. During the course of the business, the deceased borrowed money from R. Nagarjuna, T. Srinivasulu, and \'\ a,#- + |\ 2 Ur) others at daily interest, accumulating significant debts. The accused allegedly harassed the deceased both physically and mentally over the debts. Unable to bear the harassment, the deceased committed suicide by consuming poison on 22.08.2024 at Satya Krishna Bar & Restaurant, Bhimavaram. 3. Heard. Perused the record. 4. Learned counsel for the petitioner submits that in order to attract an offence under Section 108 of the BNS, all the essential ingredients of Section 45 of the BNS have to be complied with. In the present case except stating that the petitioners herein and others used to insist the deceased to repay the debt amounts, there is pr,'ma fac,'e no accusation as against the petitioners with regard to instl-gation or aiding of the deceased to commit suicide. 5. As seen from the record, the petitI-OnerS herein Were arrested on 03.03.2025 and since then they have been in judicial custody and most of the investigation might have been completed by this time and the petitioners herein have permanent abode and there is no possibility of their fleel-ng away from the justice. 6. In view of the aforesaid facts and circumstances of the case and since most of the investigation might have been completed by this time, the release of the accused would not cause hampering of investigation or tampering of witnesses, this court is inclined to .,J,-J<. a-,f - 7 . grant bail to the petitioners herein/A4 and A5, on the following conditions. i. The petitionersJ- herein/A4 and A5 shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) each with two sureties for a like sum each to the satisfaction of the learned lI Additional Civil Judge (Junior Division)-cum-lI Additional Judicial Magistrate of First Class, Bhimavaram. ii. On release, the petitioners shall appear before the station House Officer concerned, once in a fortnight i.e., on lst and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months. iii. The petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. 7.
