The present Writ Petition is filed questioning the action of the Respondent No.2 in issuing the impugned notice vide RoC.No.203/2024-G1, dated 12.03.2025 by indicating the Petitioner as encroacher in an extent of 70 Sq. Feet in Street No.30 of Sy.No.279 of Jetipalem, Venkatagiri Municipality (Town), Tirupati District, as illegal and arbitrary. 2. Heard M/s. Eluru Sesha Mahesh Babu, learned counsel for the Petitioner and Sri Gudapati Lakshminarayana, learned Standing Counsel for the Respondent No.2-Municipality. 3. When the matter is taken up for hearing, the learned Standing Counsel for the Respondent No.2-Municipality submitted that consequential order has been passed by the Respondent- Municipality on 23.03.2025 vide RoC.No.203/2024-G1 pursuant to the show-cause notice dated 12.03.2025. The Petitioner submitted that the said order was received only on 24.03.2025 and still there is a threat of demolition. On instructions, the learned Standing Counsel for the Respondent-Municipality submits that no coercive action for demolition of the Petitioner’s property will be initiated pursuant to the consequential order dated 23.03.2025 for a period of ten (10) days from today. In view of the same, the apprehension of the Writ Petitioner is redressed. 3 4. Accordingly, the Writ Petition is disposed granting liberty to the Petitioner to challenge the consequential order dated 23.03.2024. There shall be no order as to costs.
