And 3 Others Counsel for Petitioner :- Surya Bhan Singh,Jai Pratap Singh Counsel for Respondent :- Waseeq Uddin Ahmed,C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. 1. Heard Shri Ashutosh Singh, Advocate holding brief of Shri Jai Pratap Singh, learned Counsel for the petitioner and learned Counsel for the opposite party No.1 and learned Standing Counsel for the State-opposite parties. 2. The petitioner, who is also an applicant seeking allotment of retail outlet from the opposite party No.1 Indian Oil Corporation Limited has challenged the NOC granted by the opposite party No.3 in favour of opposite party No.4 on the grounds mentioned in the writ petition. We ask the petitioner's Counsel as to whether the Letter of Intent has already been issued in favour of opposite party No.4, he could not give any reply much less a satisfactory one. In these circumstances, if Letter of Intent has not been issued, the petitioner may approach the opposite party No.3 or the opposite party No.1 as the case may be pointing out the defects, if any, in the NOC given, which can always be got verified and needful shall be done but only after hearing the opposite party No.4. However, if the allotment is already been made in favour of the opposite party No.4, then of course, the remedy would be to challenge the said allotment as far as it may be permissible, which has not been done. 3. With the aforesaid observations, the writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.)
