According to petitioner, he supplied JCB Machine to National Highway Division, PWD, Barkot, District Uttarkashi as and when required. He was also given contract for whitewashing and bush cutting along the National Highway. 3. Learned counsel for the petitioner submits that although petitioner has done the work to the satisfaction of the concerned authorities; however, payment due to him has not been made so far. By means of this writ petition, petitioner has sought the following reliefs: “(i) Issue a writ, order or direction in the nature of mandamus to directing the respondent’s authorities to make the payment of Rs. 24,51,103.59 to the petitioner as he has completed his work. (ii) Issue a writ, order or direction in the nature of mandamus to directing the respondents’ authorities to make the payment of Rs. 24,51,103.59 to the petitioner with interest 18% interest.” 4. After arguing for a while, learned counsel for the petitioner submits that petitioner be permitted to make representation to the 2025:UHC:9343 concerned Executive Engineer, National Highway Division, PWD, who may be directed to take decision thereupon. 5. Learned State Counsel submits that he has no objection if writ petition is decided in terms of the prayer made by learned counsel for the petitioner. 6. Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to concerned Executive Engineer, PWD within three weeks from today. If petitioner makes such representation within stipulated time, Executive Engineer, National Highway Division, PWD, Barkot shall take decision thereupon within six months thereafter.
