Chanda, learned counsel on behalf of the petitioners has submitted that the writ petition is squarely covered by the judgment of this Court dated 30.01.2023 passed in WP(C) No. 89 of 2019, which was later followed in other similar writ petitions. He prays that in view of the judgment of this Court, the writ petitioners be given the same consideration i.e. for directions to issue to the respondents for consideration of for grant of benefit of 1st Financial upgradation under the ACP Scheme issued under Office Memorandum dated 09.08.1999, and for other consequential benefits. 2. Dr. N. Mozika, learned DSGI for the respondents does not dispute the existence of the orders in similarly situated matters, but has only objected to the time taken by the writ petitioners to approach the Court for redressal of their grievances. 3. It is noted that in a slew of matters which have appeared before this Court, filed by the cadre of the Assam Rifles in respective trades, this Court has come to concrete findings with regard to the fact that 2025:MLHC:75 7 remusteration is not a promotion and also not a financial upgradation, and therefore counting of continuance service for financial upgradation under ACP Scheme should be from the date of remusteration or date of initial entry into service. 4. As nothing remains for consideration, the writ petition is accordingly closed and disposed of in the light of the judgments rendered by this Court. 5. It is expected that the entire exercise shall completed within a period of 6(six) months from the date of receipt of this order by the respondent.
