The present petition has been filed with the following prayer : "direct the Civil Judge (S.D.), Room No.15, Sultanpur to decide the Original Suit No.623/2024, Mala Devi V/s Dharmraj and others expeditiously within a stipulated period as fixed by this Hon'ble Court, in the interest of justice." 3. It is argued that the suit has been filed along with the application under Order 39 Rule 1 & 2 CPC which is said to be pending adjudication. 4. Considering the prayer limited to the issue of mandamus, the writ petition is disposed off directing the court concerned to decide the application under Order 39 Rule 1 & 2 CPC pending in the suit no.623 of 2024 expeditiously within a period of six weeks from the date of production of a certified copy of this order.
