Heard learned Counsel for the petitioner as well as learned Standing Counsel. 2. The present petition has been filed with the following prayer: "I. Issue a writ, order or direction in the nature of mandamus commanding the opp. parties concerned to get removed the encroachment made on the public utility land Usar Gata no. 452/0.0130 hectare and charagah land gata no.458 area 0.7900 hectare situated in village Dukanaha, pargana Khiron, Tehsil Lalganj, District-Rae Bareli from the illegal encroachment of the opp. party no.6 in the interest of justice. II. Issue a writ, order or direction in the nature of mandamus commanding the opp.party no. 2 to consider and decide the application dated 10.12. 2024 as contained in Annexure no. 1 to this writ petition in the interest of justice." 3. Considering the fact that the petitioner has efficacious remedy under Section 67 of the U.P. Revenue Code, the present petition is disposed off directing the petitioner to move an appropriate application before the appropriate authority, who shall consider and decide the same in accordance with law with all expedition preferably within the period as prescribed in the statute.
